SUNLIGHT AND SAGEBRUSH – TERMS AND CONDITIONS

1. AGREEMENT TO TERMS
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you” or “your”) and Lindsey O’Connor, doing business as Sunlight and Sagebrush (“Sunlight and Sagebrush,” “we,” “us,” or “our”), governing your access to and use of the website located at https://www.sunlightandsagebrush.com, including all subdomains, mobile versions, and any related services, features, content, or applications (collectively, the “Site”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Cookie Policy, Disclaimer, Copyright Notice, and Affiliate Disclosure. If you do not agree, you must immediately discontinue use of the Site.

2. INTELLECTUAL PROPERTY RIGHTS
All original content on the Site — including but not limited to text, blog posts, product descriptions, product photography, graphics, logos, icons, video, audio, designs, and the overall “look and feel” (collectively, the “Content”) — is the proprietary intellectual property of Lindsey O’Connor and Sunlight and Sagebrush, unless otherwise noted. Certain design templates, fonts, stock photography, graphics, and social media assets used on the Site have been purchased or licensed from third-party platforms such as Canva, Etsy, Creative Market, and similar commercial licensing providers. These licensed elements are used in accordance with their respective license terms and remain the intellectual property of their original creators; no claim of ownership is made over them. You may view, download, and print Content solely for your personal, non-commercial use. Any other use — including reproduction, modification, distribution, transmission, republication, public display, or creation of derivative works — is strictly prohibited without our express prior written consent.

3. PRODUCTS AND SERVICES
We offer handmade, small-batch botanical body care and aromatherapy products (“Products”) for external use only. Product categories include, but are not limited to:

  • Botanical body oils

  • Essential oil-based perfume/roll-on oils

  • Hydrosol-based facial and body mists

  • Natural lip balms

  • Other topical self-care and wellness items

We also provide holistic educational services (flower essence consultations, personalized remedies, and related content), which are subject to separate booking terms through our designated scheduling platform. The sale of Products through the Site is separate from these services.

4. USER REPRESENTATIONS AND AGE RESTRICTION
By using the Site or purchasing Products, you represent and warrant that:

  • You are at least 18 years of age or the age of majority in your jurisdiction.

  • All information you provide — including billing, shipping, and contact details — is accurate, current, and complete.

  • You will maintain and promptly update your account and order information.

  • You will not use the Site for any unlawful or unauthorized purpose.

  • You are not located in a country subject to a U.S. government embargo or designated as a “terrorist-supporting” country.

5. PRODUCT DESCRIPTIONS, ALLERGENS, AND USE
We strive to describe our Products accurately, including listing all ingredients. However, we do not warrant that Product descriptions, images, or other Content are error-free, complete, or current. It is your responsibility to:

  • Carefully review the full ingredient list prior to purchase, especially if you have known allergies, sensitivities, or medical conditions.

  • Perform a patch test on a small area of skin before full application.

  • Discontinue use immediately if irritation, redness, or discomfort occurs and consult a healthcare professional if needed.

All Products are handcrafted in small batches using natural ingredients, and slight variations in color, scent, or texture may occur. These variations do not render a Product defective or qualify for a refund based on preference alone.

6. ORDERS, PAYMENTS, AND SHIPPING

  • Order Acceptance: All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including errors in pricing or Product descriptions, suspected fraud, or stock limitations. If we cancel an order after payment has been processed, a full refund will be issued.

  • Pricing and Taxes: All prices are in U.S. dollars. Applicable sales tax will be calculated and added at checkout based on California law and the shipping destination. You are responsible for any additional taxes or duties.

  • Payment Processing: Payments are processed securely by Stripe, a third-party payment processor. We do not store or have access to your full credit card or debit card numbers. By placing an order, you agree to Stripe’s terms of service and authorize Stripe to charge the total amount.

  • Shipping: We ship only within the United States. Orders are processed and shipped using third-party shipping carriers and fulfillment providers (such as USPS, via platforms like Pirate Ship). The specific carrier and service level will be chosen at our discretion based on package size, destination, and delivery speed. Shipping costs and estimated delivery times are displayed at checkout. Once your order ships, you will receive a confirmation email with tracking information where available.

  • Title and Risk of Loss: Title to Products passes to you upon our delivery to the shipping carrier. We are not responsible for delays, loss, or damage caused by the carrier, customs, or events outside our control (e.g., natural disasters, pandemics, strikes).

7. CANCELLATIONS, RETURNS, AND REPLACEMENTS

  • Order Cancellations: You may request to cancel an order before it ships by contacting us at lindsey@sunlightandsagebrush.com. Once an order has shipped, it cannot be cancelled.

  • No Returns/Exchanges on Personal Care Products: Due to hygiene and safety considerations, we do not accept returns or offer exchanges on opened or used Products. All sales are final unless the item arrives damaged, defective, or is lost in transit.

  • Damaged/Defective/Lost Shipments: If your order arrives damaged, defective, or fails to arrive, you must notify us within 7 calendar days of delivery (or expected delivery) by emailing lindsey@sunlightandsagebrush.com with your order number, a description of the issue, and photos of the damage (if applicable). At our sole discretion, we may offer a replacement Product or a refund. We are not liable for damage resulting from misuse, alteration, or normal wear and tear.

8. PROHIBITED ACTIVITIES
In addition to other prohibitions set forth in these Terms, you agree not to:

  • Use the Site for any illegal, harassing, abusive, or fraudulent purpose.

  • Interfere with or circumvent the security features of the Site or any related website.

  • Copy, reproduce, or scrape any Content for a competing business or commercial purpose without written permission.

  • Upload or transmit viruses or any other type of malicious code.

  • Use any robot, spider, or other automatic device or manual process to monitor or copy the Site.

  • Engage in any activity that imposes an unreasonable or disproportionately large load on our infrastructure.

We reserve the right to terminate your access to the Site for any violation of these prohibitions.

9. DISCLAIMER OF WARRANTIES; “AS IS” BASIS
The Site and all Products are provided on an “AS IS” and “AS AVAILABLE” basis without any representations or warranties, express or implied. To the fullest extent permitted by law, Sunlight and Sagebrush and Lindsey O’Connor disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, secure, or free of viruses. We are not responsible for any adverse reactions arising from the use of Products; all information provided is educational and not medical advice.

10. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall Sunlight and Sagebrush, Lindsey O’Connor, or their affiliates, contractors, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including but not limited to personal injury, allergic reactions, lost profits, loss of data, or property damage — arising out of or in connection with your use of the Site, the Products, or these Terms, whether based on contract, tort, strict liability, or otherwise, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim related to a Product shall be limited to the amount you paid for that Product. Some states do not allow limitations on implied warranties or the exclusion of certain damages, so these limitations may not apply to you.

11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Sunlight and Sagebrush, Lindsey O’Connor, and our respective employees, contractors, licensors, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; (c) your misuse of any Product; or (d) any user content you submit or transmit through the Site.

12. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by and construed in accordance with the laws of the State of California, without giving effect to any conflict-of-law principles. Any dispute, claim, or controversy arising from or relating to these Terms, the Site, or Products shall be resolved exclusively in the state or federal courts located in San Diego County, California. You irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection based on improper venue or forum non conveniens.

13. MODIFICATIONS TO TERMS AND SITE
We reserve the right to update, change, or replace any part of these Terms at any time. Any changes will be effective immediately upon posting to the Site with a revised “Last Updated” date. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms. We also reserve the right to modify or discontinue the Site or any Products, temporarily or permanently, without notice. We shall not be liable for any modification, suspension, or discontinuance.
